On February 15, 2019, President Donald J. Trump declared a national emergency (link here) due to a “a border security and humanitarian crisis that threatens core national security interests and constitutes a national emergency.” In your reading this week you learned about the Constitution’s separation of powers, checks and balances, and the role of the Supreme Court.
Based on your studies, do you believe the President has the authority to re-appropriate funds in response to Congressional inaction? Be sure to consider the long history of Presidential emergency declarations, not only the most current, politically controversial declaration.
