There are strict policies governing the access of customer information and there are strict action/penalty against mis-use of information.
If a customer subscribes to DND, the company cannot send any promotional sms/message to the customer. In case any company violates such policies the company would be liable to be penalized.The government body or the Telecom department which looks after the mobile operators looks into such issues.
